Welcome to NeuroLifeNow (NLN, as defined below). By using NLN you will be joining a community of over 12 million people in the UK who are affected by over 470 neurological conditions. By being an active part of this community, your experiences will be collated and presented to meaningfully inform and influence key decision makers at local and national level, to inform and influence improvements to care and support.

WHO WE ARE: NeuroLifeNow (or NLN) is a person reported experience & survey research platform developed and managed by the Brain & Spine Foundation (registered charity 1098528) (B&SF), working in collaboration with the Neurological Alliance of England (registered charity 1039034) (NA). These Terms are a binding contract between the Individual and B&SF concerning your use of NLN.

IMPORTANT: Use of NLN will enable you to actively contribute to the community but will not give health or support advice. FOR ALL MEDICAL EMERGENCIES, YOU SHOULD CONTACT YOUR HEALTHCARE PROFESSIONAL IMMEDIATELY. DO NOT USE NLN, OR ANY NLN CONTACT DETAILS, TO COMMUNICATE MEDICAL EMERGENCIES.

Please note: These Terms (together with our Privacy & Data Protection Policy provide you with information about the B&SF, NeuroLifeNow (NLN) and set out the legal terms and conditions by which you may access and use NLN.

These Terms will apply to any use of NLN. By using NLN you confirm that you accept and agree to comply with these Terms, so please read these terms carefully and make sure that you understand them before registering to use NLN.

These Terms may be updated from time to time, so please check these Terms regularly to ensure you understand the terms which will apply at that time.

 

  1. DEFINITIONS USED IN THESE TERMS

 

“NeuroLifeNow ” and “NLN “ is applicable software designed to run on a computer or mobile device (such as a smartphone or tablet), through a web server and is accessed by you or an Invitee through a web browser with an active internet connection.

“Privacy Policy” means the privacy and data protection policy applicable to your use of NLN which was notified to you during the completion of the survey and which is available for on our website.  

“Data Access Board” refers to a group established by the B&SF and the Neurological Alliance of England to review applications from sources such as NHS Digital, Public Health England, NLN users, and other organisations to access data from NLN database. The Board is responsible for assessing applications requesting access to data extracts and controlling the criteria for accepting, accepting with conditions, or rejecting any such requests or applications.

“Disclaimer(s)” mean(s) any notices or disclaimers which you are notified of from time to time and accept as part of NLN.

“Individual” means the holder of the relevant NLN user, which for the purposes of these Terms may also be referred to as “you”.

“Invitee” means someone who is invited by an Individual to complete surveys on behalf of that Individual.

“Maintenance” refers to the modification of NLN from time to time to correct faults or to improve performance or other attributes.

“Research” refers to an activity undertaken by NLN team, both clinical and academic scientists at universities or industry partners in the UK or globally.

“Terms” means these Terms and Conditions, which may be updated by B&SF from time to time.

“User Generated Content” means information an Individual provides through NLN in the form of questions you submit or questionnaires you answer.

 

YOUR PERSONAL DATA

  1. These Terms refer to and sit alongside the Privacy & Data Protection Policy which, along with the terms of any consents you may have provided (and any other notices provided to you within the functionality of NLN), set out the basis on which B&SF may process any personal data collected from you, or provided by you, in using NLN.

 

  1. Your account and registration information will be used as necessary for the operation and fulfilment of these Terms. B&SF and NLN may use your contact details provided to send you updates and account information necessary for the service, subject where applicable to your preferences.

 

  1. These Terms are without prejudice to any other marketing consents or communication preferences you may have provided to B&SF by other means, including the B&SF or NLN website.

USE OF THE NEUROLIFENOW

  1. NLN is designed to be an interface through which an Individual affected by one or more neurological conditions may enter certain personal information including concerning their lifestyle and confidential healthcare information.

 

  1. Access to NLN will be activated once and you have agreed to these Terms & Conditions and the Privacy & Data Protection Policy. During the registration process the Individual must agree to these Terms, as well as accepting the Privacy Policy and our privacy and healthcare Disclaimers, which form part of these Terms. However, please note that B&SF and NLN reserve the right to refuse or deny any application access to NLN for any reason.

 

  1. It is your responsibility if your if device has been compromised in any way, or if a device on which an Individual has previously logged into NLN has been lost or stolen. In such event an Individual must notify B&SF by emailing info@neurolifenow.org.

 

  1. It is your responsibility to keep your email address and preferences up to date with NLN and the B&SF to ensure that you receive notification of newly released information and general notices relating to NLN in a timely manner. This can be done by emailing us on info@neurolifenow.org. B&SF is not responsible for any loss or damage which may result from an Individual failing to provide an up-to-date email address.

 

  1. It is understood and accepted that some Individuals may require someone else to access NLN on their behalf. It is the Individual’s responsibility to control who has access to their details, what type of access they have, and for what duration.

 

  1. You can discontinue use of NLN and/or any communications at any time by emailing info@neurolifenow.org.

 

  1. If you cancel your registration with NLN, B&SF will remove your contact details from the B&SF systems (save for some basic information about you, which may be kept as a record that you have asked to cancel your registration). B&SF will however continue to store certain anonymous and/or aggregated data (including User Generated Content) for analytical, statistical and Research purposes, as set out in the Privacy & Data Protection Policy.

 

SHARING OF INFORMATION AND USER GENERATED CONTENT

  1. All personal information stored in NLN will be handled securely by B&SF and in accordance with the Privacy & Data Protection Policy.

 

  1. The Individual agrees that NLN is a service offered as an information management tool and understands that it provides the Individual with online access any User Generated Content that the Individual has entered into NLN. The Individual is solely responsible for any sharing of such User Generated Content that Individual intentionally or unintentionally communicates to others, including to and through any Individual’s authorised Invitee(s).An Individual agrees that any User Generated Content may be shared by the B&SF in an anonymised form with researchers, clinicians, and other suitable parties if the B&SF consider that this information would be valuable for Research or inform and influence key decisions relating to the care, support and quality of life of those affected by neurological conditions, and such data sharing is roved by the Data Access Board.
  2. If an Individual decides that they wish to limit the personal information they wish to share with the B&SF/NLN, or withdraw any consent previously given, then that Individual can contact B&SF/NLN at any time by emailing info@neurolifenow.org. If requested, the B&SF will delete any information which allows the Individual to be personally identified by reference to their User Generated Content, but with B&SF retaining access to the anonymised User Generated Content for Research purposes.

 

  1. The B&SF will process all personal data in line with the principles defined in the Data Protection Act 2018 and the UK General Data Protection Regulation, and will ensure that personal data in NLN will be processed in ways that are:

 

  1. Lawful, fair and transparent.
  2. Collected for specific explicit and legitimate purposes.
  3. Adequate
  4. Relevant and limited.
  5. Accurate and up to date.
  6. Not kept for longer than necessary; and
  7. Secure

 

MISUSE OF THE NEUROLIFENOW

  1. The Individual agrees that they will not use NLN to:

 

a. post or send any harassing, defamatory or offensive material, or material which infringes the property rights of others (including but not limited to confidential information and intellectual property);

b. extract or misuse the personal data of others.

c. disseminate any unsolicited or unauthorised advertising, promotional materials, or any other form of solicitation or for any other commercial purposes.

d. create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from NLN, whether or not intended to support a commercial enterprise.

e. transmit or re-circulate any material obtained from NLN to any third party except where expressly permitted on NLN.

f. download or “screen grab” content from NLN, nor remove the copyright or trademark notice(s) from any copies of any content whether or not made in breach of these Terms.

g. harm NLN or disseminate any material that contains software viruses, or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or otherwise to hack (or attempt to hack) into NLN;

h. in any way that is otherwise unlawful (including fraudulent) or that might bring B&SF or NLN into disrepute.

 

  1. The B&SF accepts no responsibility for any harassing, defamatory, offensive, or otherwise unlawful or infringing material that an Individual may post in NLN by way of User Generated Content or otherwise. Any views expressed by an Individual through NLN should not be treated as the views of the B&SF/NLN or NA or views that the B&SF/NLN or NA endorse.

 

  1. Your use of NLN will be logged for support purposes and to detect or identify faults, issues or misuse. The B&SF reserves the right, at its sole discretion, to suspend or discontinue an Individual’s use of NLN and general use of NLN itself, and the Individual will be notified if their access is discontinued.

 

INTELLECTUAL PROPERTY

  1. The B&SF/NLN Is the owner or the licensee of all intellectual property rights on NLN, registered or otherwise, and in the material published on it (including NLN name and logo). All text, code, designs and images are protected by copyright and design laws and treaties worldwide.

 

  1. The Individual hereby grants the B&SF/NLN (and its assignees and successors in title) the irrevocable right to use, share and license any User Generated Content posted via NLN for the purposes and in the manner set out in these Terms. The Individual expressly waives any moral rights in their User Generated Content, including the right to credit or attribution, and agrees that such User Generated Content may be used freely by the B&SF/NLN without credit or attribution in accordance with these Terms.

 

  1. The B&SF/NLN grants each Individual a limited, revocable licence to use NLN and the associated services in accordance with these Terms. This licence expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of NLN and the associated services or making any derivative of NLN or the associated services without the express agreement of the B&SF.

 

  1. All rights are reserved, and no rights are hereby granted by B&SF or NLN except as strictly necessary for an Individual’s use of NLN. Nothing in these Terms shall be construed as granting an Individual any wider licence to use or reproduce any content included on NLN or the associated services. No use of the B&SF or NLN name, logos and/or other trademarks may be made by an Individual without separate express written permission.

 

THIRD PARTY CONTENT

  1. NLN contains links to websites operated by third parties which are provided for Individual’s convenience only. The B&SF does not control such websites and B&SF is not responsible for the content and performance of these sites. The inclusion of links to other websites does not imply any endorsement of the material on the websites or any association with their operators.

 

  • The B&SF does not operate, control, or endorse any information, products, or services provided by third parties through the internet. Use of other sites is strictly at an Individual’s own risk, including, but not limited to, use of cookies or similar technologies, and any risks associated with destructive viruses. Each Individual is responsible for viewing and abiding by the terms and conditions of use and the privacy statements of any third-party websites accessed.

 

LIABILITY PROVISIONS AND DISCLAIMERS

  1. On NLN you may be offered automatic links to or information about other websites. You acknowledge that the content on those pages is not subject to the control of B&SF, their owners may be independent from the B&SF and the B&SF does not endorse or accept any responsibility for their content. The B&SF will not be liable for any loss or damage that may arise from your use of such links or other websites.

 

  • Please note that NLN is intended only for domestic and private use. As such, the B&SF and NLN will not accept any liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

  1. As you were fully notified and duly accepted as part of the registration Disclaimers, and as you again accept by these Terms, NLN will not give medical, health or support advice and should not be used for medical emergencies. B&SF and NLN exclude to the fullest extent permitted by applicable laws all liability in any damage, loss or injury suffered as a result of your failure to understand this.

 

  1. We may have a safeguarding duty to share concerns that we have about conversations, emails, posts, messages, replies, questions or comments that indicateyou or someone else might be at risk, with the relevant services (including names and contact details where necessary, and with or without notice or reference to you). This includes any reference to or indication of abuse or neglect. However, we do not specifically monitor NLN for such concerns or disclosures and NLN is not an appropriate forum to raise such concerns, which should properly be referred directly to the relevant local authorities or emergency services.

 

  • NLN, and NLN’s Insights and tools are works-in-progress and have not been fully peer-reviewed or tested. Whilst every effort has been made to ensure the information presented is accurate, the B&SF cannot guarantee that these are complete, accurate or error-free.

 

  • In NLN, any attribution that an Individual makes between a side effect and a form of medication or treatment represents that Individual’s view and not the view of the B&SF.

 

  1. B&SF and NLN exclude to the fullest extent permitted by applicable laws all liability in connection with any damage or loss caused by computer viruses or other malicious code originating or contracted from NLN. B&SF recommends that you should virus check all materials downloaded from any emails you receive from B&SF/NLN and regularly check your devices for the presence of viruses and other malicious code.

 

  1. To the extent permitted by law, the B&SF and NLN exclude all other conditions, warranties, representations, or other terms which may apply to NLN or any content on it, whether express or implied. B&SF and NLN will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

a. use of, or inability to use, NLN.

b. failure to read or accept our Privacy Policy and any Disclaimers or other notices which you accepted when registering; or

c. use of or reliance on any content displayed on NLN.

 

OTHER IMPORTANT TERMS

  1. Each paragraph of these Terms operates separately. If any court or relevant authority decides that any paragraph is unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

 

  1. If the B&SF fails to insist that you perform any of your obligations under these Terms, or if the B&SF does not enforce its rights against you, or delays in doing so, that will not mean that the BS&F has waived its rights against you and will not mean that you do not have to comply with those obligations.

 

  1. These Terms are governed by English law and are available only in English. The B&SF and you both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising under these Terms.

 

COMPLAINTS AND SUGGESTIONS

  • If you have any:
    a. concerns or feedback you wish to raise with B&SF or NLN;
    b. complaints or comments about the services provided; or
    c. queries about these Terms or about NLN generally, please do not hesitate to contact us by email at info@neurolifenow.org.

 

CHANGES TO NLN AND THESE TERMS

  1. The B&SF reserves the right to carry out periodic Maintenance and updates to NLN. When making these changes, every effort will be taken to minimise the disruption to Individuals and Invitees using NLN.

 

  1. B&SF reserves the right to change any part of the We Are Neuro Community, NLN, or the third-party content, as well as to change these Terms or to terminate NLN in its entirety, and B&SF does not accept any liability which may arise from Its exercise of that right. B&SF will give you reasonable notice of any such changes via NLN where possible. Please check here regularly for the latest copy of these Terms.

“গোপনীয়তা নীতি” মানে হচ্ছে সেই সকল গোপনীয়তা এবং ডেটা সুরক্ষা নীতি যা আপনার NLN ব্যবহারের ক্ষেত্রে প্রযোজ্য, আপনাকে এই সার্ভে সম্পন্ন করার সময় এই বিষয়ে জানানো হয়েছিল এবং এটি আমাদের ওয়েবসাইট-এ এভেইলেবল রয়েছে।

“ব্যক্তি” বলতে সংশ্লিষ্ট NLN ব্যবহারকারীকে বোঝানো হয়, এই শর্তাবলী বোঝানোর উদ্দেশ্যে কিছু স্থানে “আপনি” হিসেবেও সম্বোধন করা হয়েছে।

“রক্ষণাবেক্ষণ” বলতে সময়ের সাথে সাথে NLN-এ নিয়ে আসা সে পরিবর্তনকে বোঝানো হয় যা কোন ভুল ঠিক করার জন্যে অথবা কার্যক্ষমতা বৃদ্ধি করার জন্যে অথবা অন্যান্য বৈশিষ্ট্যের জন্য নিয়ে আসা হয়।

 

“গবেষণা” বলতে সে কার্যক্রমকে বোঝানো হয় যা NLN দল, ইউনিভার্সিটির ক্লিনিক্যাল এবং অ্যাকাডেমিক বিজ্ঞানী অথবা UK-এর মধ্যে কিংবা বিশ্বের যেকোনো প্রান্তের পার্টনারগণ সম্পন্ন করে থাকেন।

 

“শর্তাবলী” বলতে এই শর্তাবলীকে বোঝানো হচ্ছে যার মধ্যে B&SF সময়ের সাথে সাথে পরিবর্তন নিয়ে আসতে পারে।

 

“ইউজারের জেনারেট করা কনটেন্ট” বলতে সেসকল তথ্যকে বোঝানো হয় যা NLN-এর মাধ্যমে একজন ব্যক্তি প্রদান করেন তার জমা করা প্রশ্ন কিংবা যেসকল প্রশ্নাবলীর উত্তর দিচ্ছেন সে আঁকারে।

 

আপনার ব্যক্তিগত তথ্য

  1.   1. NLN-এর অ্যাক্সেস একবার সক্রিয় করা হবে এবং আপনি তখন আপনি এই শর্তাবলী এবং গোপনীয়তা ও ডেটা প্রোটেকশন নীতি-তে সম্মতি দিয়ে থাকবেন। ব্যক্তিকে এই শর্তাবলী এবং এর পাশাপাশি গোপনীয়তা নীতি ও আমাদের গোপনীয়তা এবং স্বাস্থ্য পরিচর্যা দাবিত্যাগে সম্মতি দিতে হবে, এগুলো শর্তাবলীর অংশ। তবে, অনুগ্রহ করে মনে রাখুন যে B&SF ও NLN এই অধিকার রাখে যে তার যেকোনো সময় যেকোনো কারণে NLN থেকে ডেটা অ্যাক্সেস করার যেকোনো আবেদন প্রত্যাখ্যান কিংবা খারিজ করতে পারেন।

  1. গোপনীয়তা এবং ডেটা সুরক্ষা নীতি মেনে চলে B&SF সেসকল ব্যক্তিগত তথ্যের ব্যবস্থাপনা নিরাপদে করবে যা NLN-এর মধ্যে সংরক্ষণ করা হয়েছে।

 

  1. ব্যক্তি সম্মতি দিচ্ছেন যে NLN হচ্ছে অফার করা এমন একটি পরিষেবা যা তথ্য ব্যবস্থাপনা টুল হিসেবে কাজ করে এবং বোঝেন যে এটি ব্যবহার করার মাধ্যমে NLN-এ অন্যান্য ব্যক্তিগণ যে ইউজার জেনারেট করা কনটেন্ট প্রবেশ করিয়েছেন সেগুলো তিনি অ্যাক্সেস করতে পারবেন। ব্যক্তির অনুমোদিত আমন্ত্রণ প্রাপ্ত ব্যক্তিদের কাছে কিংবা তাদের মধ্যে দিয়ে, ব্যক্তি ইচ্ছাকৃতভাবে কিংবা অনিচ্ছাকৃতভাবে যে ইউজারের জেনারেট করা যেকোনো ধরনের কনটেন্ট-এর যেকোনো ধরণের শেয়ার করবে তার জন্য শুধুমাত্র সেই ব্যক্তিই নির্ভরশীল।

  1. যদি একজন ব্যক্তি B&SF/NLN-এর সাথে যে পরিমাণ ব্যক্তিগত তথ্য তারা শেয়ার করেন তা সীমাবদ্ধ করার অথবা পূর্বে দেয়া হয়েছে এমন অনুমতি প্রত্যাখ্যান করার সিদ্ধান্ত নেন তবে সে ব্যক্তি যেকোনো সময় info@neurolifenow.org ঠিকানায় ইমেইল করার মাধ্যমে B&SF/NLN-এর সাথে যোগাযোগ করতে পারবে। অনুরোধের ভিত্তিতে, ব্যক্তির ইউজার জেনারেট করা কনটেন্টের রেফারেন্স অনুযায়ী ব্যক্তিকে শনাক্ত করা যাবে এমন যেকোনো তথ্য B&SF মুছে ফেলবে তবে অজ্ঞাতনামা আঁকারে রাখা ইউজারের জেনারেট করা কনটেন্টের অ্যাক্সেস B&SF তার নিজের কাছে গবেষণার উদ্দেশ্যে রেখে দিবে।

 

  1. ডেটা প্রোটেকশন আইন 2018 এবং UK জেনারেল ডেটা প্রোটেকশন রেগুলেশন-এ সংজ্ঞায়িত নীতি মেনে নিয়ে B&SF সকল ব্যক্তিগত ডেটার প্রক্রিয়াকরণ করবে এবং NLN-এর ব্যক্তিগত ডেটাগুলো এমন ভাবে প্রক্রিয়াকরণ করবে যেন সেগুলো নিম্নেরমতো হয়:

 

  1. আইনগত, ন্যায্য এবং স্বচ্ছ।
  2. নির্দিষ্টভাবে ব্যক্ত এবং বৈধ উদ্দেশ্যে সংগৃহীত।
  3. পর্যাপ্ত
  4. সংশ্লিষ্ট এবং সীমাবদ্ধ।
  5. নিখুঁত এবং আপ-টু-ডেট।
  6. প্রয়োজনের বেশি সময় রাখা হবে না, এবং
  7. নিরাপদ

 

নিউরোলাইফনাউ-এর অপব্যবহার

  1. ব্যক্তি উল্লেখিত কারণে NLN ব্যবহার না করার ক্ষেত্রে সম্মতি দিচ্ছেন:

 

  1. হয়রানিমূলক, মানহানিকর অথবা অপমানজনক কিছু কিংবা এমন কিছু পোস্ট করা অথবা পাঠানো যা অন্যদের সম্পত্তির অধিকারকে বাঁধা দেয় (গোপন তথ্য এবং বুদ্ধিবৃত্তিক সম্পত্তি এর মধ্যে অন্তর্ভুক্ত তবে এগুলোতেই তা সীমাবদ্ধ নয়);
  2. অন্যদের ব্যক্তিগত তথ্য এক্সট্রাক্ট করা অথবা সেগুলোর অপব্যবহার করা।
  3. অযাচিত বা অননুমোদিত অ্যাডভার্টাইজিং, প্রোমশনাল ম্যাটারিয়াল অথবা অন্য ধরণের অনুরোধ অথবা অন্য যেকোনো কমার্শিয়াল উদ্দেশ্যে প্রচার করা।
  4. NLN থেকে ডাউনলোড করা কিংবা অন্যভাবে পাওয়া ম্যাটারিয়াল অন্তর্ভুক্ত এমন ডেটাবেজ (ইলেকট্রনিক কিংবা অন্য ধরণের) তৈরি করা, তার উদ্দেশ্যে কমার্শিয়াল এন্টারপ্রাইজের সহায়তা করার জন্য হোক কিংবা না হোক।
  5. NLN যেসকল স্থানে অনুমোদন দিয়েছে সেগুলো ব্যতীত যেকোনো তৃতীয় পক্ষের কাছে NLN থেকে পাওয়া যেকোনো ম্যাটারিয়াল ট্রান্সমিট অথবা পুনরায় সম্প্রচার করা।
  6. NLN থেকে ডাউনলোড কিংবা “স্ক্রিন গ্র্যাব” করা, এই শর্তাবলী লঙ্ঘন রোধ করার জন্য তৈরি হোক কিংবা না হোক, যেকোনো কনটেন্ট থেকে সংশ্লিষ্ট সকল কপিরাইট অথবা ট্রেডমার্ক নোটিশ সরিয়ে ফেলা।
  7. NLN-কে ক্ষতিগ্রস্ত করা অথবা এমন ম্যাটারিয়াল প্রচার করা যার মধ্যে ভাইরাস অথবা অন্য কোন কম্পিউটার কোড, ফাইল অথবা প্রোগ্রাম আছে যা তৈরি করা হয়েছে কোনো কম্পিউটারের সফটওয়্যার অথবা হার্ডওয়্যার অথবা টেলিকমিউনিকেশন সরঞ্জামের কার্যক্রমে বাঁধা দেয়ার জন্য, ক্ষতিগ্রস্ত করার জন্য অথবা সীমাবদ্ধ করার জন্য কিংবা NLN-এ হ্যাক করার জন্য (অথবা হ্যাক করার চেষ্টা করার জন্য);
  8. এমন কোন পদ্ধতিতে যা বেআইনি (এর মধ্যে প্রতারণা অন্তর্ভুক্ত) কিংবা যার ফলে B&SF ও NLN-এর সম্মানহানি হতে পারে।

 

  1. একজন ব্যক্তি ইউজার জেনারেট কনটেন্ট অথবা অন্য কিছু হিসেবে NLN-এ পোস্ট করতে পারে এমন যেকোনো হয়রানিমূলক, মানহানিকর, অপমানজনক অথবা বেআইনি কিংবা অধিকার ক্ষুণ্ণকারী ম্যাটারিয়ালের জন্য B&SF কোনো ধরণের দায়িত্ব নিবে না। NLN-এর মাধ্যমে কোন একজন ব্যক্তির প্রকাশিত মতামতকে B&SF/NLN অথবা NA-এর মতামত হিসেবে কিংবা B&SF/NLN অথবা NA অনুমোদন দেয় এমন মতামত হিসেবে দেখা যাবে না।

 

  1. সহায়তা প্রদানের উদ্দেশ্যে এবং কোন ধরণের ভুল, সমস্যা অথবা অপব্যবহার শনাক্ত করার জন্য আপনার NLN-এর ব্যবহারের লগ রাখা হবে। একান্ত নিজের বিচক্ষণতায়, B&SF এই অধিকার সংরক্ষণ করে যে যেকোনো সময় একজন ব্যক্তির NLN ব্যবহার এবং NLN-এর সাধারণ ব্যবহার বন্ধ করতে অথবা বাতিল করতে পারে এবং যদি কোন ব্যক্তির অ্যাক্সেস বন্ধ করে দেয়া হয় তবে তাকে এই বিষয়ে জানানো হবে।

 

বুদ্ধিবৃত্তিক সম্পত্তি

  1. রেজিস্টার্ড হোক কিংবা না হোক, NLN-এর সকল বুদ্ধিবৃত্তিক সম্পত্তির অধিকার এবং এখানে প্রকাশিত ম্যাটারিয়ালের মালিকানা ও লাইসেন্স B&SF-এর (এর মধ্যে NLN-এর নাম এবং লোগো অন্তর্ভুক্ত)। সকল ধরণের টেক্সট, কোড এবং ছবি কপিরাইট এবং ডিজাইন আইন ও ট্রিটি-এর অধীনে বিশ্বজুড়ে সুরক্ষিত।

 

  1. ব্যক্তি এতদ্বারা B&SF/NLN (এবং তাদের নির্ধারিত ও শিরোনামের উত্তরাধিকারদের)-কে, এই শর্তাবলীতে নির্ধারিত উদ্দেশ্য এবং পদ্ধতির ক্ষেত্রে NLN-এর মাধ্যমে পোস্ট করা ইউজার জেনারেট করা কনটেন্ট ব্যবহার, শেয়ার এবং লাইসেন্স করার অপরিবর্তনীয় অধিকার দিচ্ছে। ইউজারের জেনারেট করা কনটেন্ট থেকে ব্যক্তি বিশেষভাবে যেকোনো মানবিক অধিকার ক্ষুণ্ণ করেন এর মধ্যে ক্রেডিট অথবা অ্যাট্রিবিউশনের অধিকার অন্তর্ভুক্ত এবং তিনি এই বিষয়ে সম্মতি দেন যে ইউজার জেনারেট করা কনটেন্টগুলো B&SF/NLN কোন ধরণের ক্রেডিট অথবা অ্যাট্রিবিউশন ছাড়া এই শর্তাবলী মেনে বিনামূল্যে ব্যবহার করতে পারবে।

 

  1. B&SF/NLN প্রত্যেক ব্যক্তিকে একটি সীমিত পরিসরের, প্রত্যাহারযোগ্য লাইসেন্স দেন যা তারা NLN-এর সাথে এবং সংশ্লিষ্ট পরিষেবায় এই শর্তাবলীর অধীনে ব্যবহার করতে পারবে। এই লাইসেন্স-এর মধ্যে বিশেষভাবে, কোন ধরণের সীমাবদ্ধতা ছাড়া, NLN এবং সংশ্লিষ্ট সকল পরিষেবার যেকোনো ধরনের পুনরায় সৃষ্টি, নকল তৈরি, বিক্রয়, পুনরায় বিক্রয়, অথবা কমার্শিয়াল ব্যবহার অথবা B&SF-এর সরাসরি অনুমোদন ছাড়া NLN কিংবা সংশ্লিষ্ট পরিষেবা উদ্ভূত কোন কিছু তৈরি করার অনুমতি খারিজ করে।

 

  1. সকল ধরণের অধিকার সংরক্ষণ করা হয়েছে এবং B&SF অথবা NLN থেকে এখন থেকে কোন ধরণের অধিকার ততক্ষণ দেয়া হচ্ছে না যতক্ষণ তা একজন ব্যক্তির NLN ব্যবহার করার জন্য বাধ্যতামূলকভাবে প্রয়োজনীয়। এই শর্তাবলীর কোন অংশের ব্যাখ্যা এমন দেয়া যাবে না যেখানে মনে হয় যে একজন ব্যক্তিকে NLN অথবা সংশ্লিষ্ট পরিষেবার অন্তর্ভুক্ত কোন কনটেন্ট ব্যবহার করার অথবা পুনরায় তৈরি করার বৃহত্তর লাইসেন্স দেয়া হচ্ছে। একজন ব্যক্তি B&SF অথবা NLN-এর নাম, লোগো এবং/অথবা অন্যান্য ট্রেডমার্ক কোন ধরণের সরাসরি লিখিত অনুমোদন ছাড়া ব্যবহার করতে পারবেন না।

 

তৃতীয় পক্ষের কনটেন্ট

  1. NLN-এর মধ্যে এমন লিংক আছে যা তৃতীয় পক্ষ দ্বারা চালিত এবং এগুলো শুধুমাত্র ব্যক্তির সহায়তার জন্য প্রদান করা হয়। B&SF এমন ধরণের ওয়েবসাইটগুলো নিয়ন্ত্রণ করে না এবং এই সাইটের কনটেন্ট এবং কার্যক্ষমতার জন্য B&SF দায়ী নয়। অন্যান্য ওয়েবসাইটের লিংক অন্তর্ভুক্ত করা মানে এই নয় যে অন্যান্য ওয়েবসাইটের ম্যাটারিয়ালের অনুমোদন আমরা দেই অথবা সেগুলোর চালকদের সাথে আমাদের সম্পৃক্ততা আছে।

 

  • ইন্টারনেটের মাধ্যমে প্রদান করা যেকোনো তথ্য, পণ্য অথবা পরিষেবা-এর চালনা, নিয়ন্ত্রণ অথবা সমর্থন B&SF করে না। অন্য সাইট ব্যবহার করা কঠোরভাবে ব্যক্তির নিজস্ব ঝুঁকির বিষয় যার মধ্যে অন্তর্ভুক্ত আছে, কুকিজ কিংবা সমমানের প্রযুক্তির ব্যবহার এবং ক্ষতিকারক ভাইরাসের সাথে সম্পৃক্ত যেকোনো ঝুঁকি তবে এগুলোতেই তা সীমাবদ্ধ নয়। প্রত্যেক ব্যক্তি নিজে ব্যবহারের এই শর্তাবলী দেখার জন্য এবং মেনে চলার জন্য ও অ্যাক্সেস করা যেকোনো তৃতীয় পক্ষের ওয়েবসাইটের গোপনীয়তার বিবৃতির জন্য দায়ী থাকবেন।

 

দায়বদ্ধতার বিধান এবং দাবিত্যাগ

  1. NLN-এ অন্যান্য ওয়েবসাইট সম্পর্কে আপনার কাছে স্বয়ংক্রিয়ভাবে লিংক অফার করা হবে কিংবা তথ্য প্রদান করা হবে। আপনি এই বিষয়গুলোতে সম্মতি দিচ্ছেন যে সে পেজগুলোর কনটেন্ট B&SF-এর নিয়ন্ত্রণাধীন নয়, তাদের মালিক B&SF থেকে পৃথক হতে পারে এবং তাদের কনটেন্টে B&SF কোন ধরণের সমর্থন প্রদান করে না অথবা দায়িত্ব নেয় না। এমন লিংক অথবা অন্যান্য ওয়েবসাইট ব্যবহার করার ফলে আপনার যেসকল ক্ষতি হতে পারে তার জন্য B&SF দায়ী থাকবে না।

 

  1. অনুগ্রহ করে মনে রাখুন যে NLN শুধুমাত্র দেশের মধ্যে ব্যক্তিগত ব্যবহারের জন্য তৈরি করা হয়েছে। এমতাবস্থায়, আপনার লভ্যাংশের ক্ষতি হওয়ার, ব্যবসার ক্ষতি হওয়ার, ব্যবসায় বাঁধা পাওয়ার অথবা ব্যবসার সুযোগ হাত ছাড়া হওয়ার মতো বিষয়ের দায়ভার B&SF ও NLN গ্রহণ করবে না।

 

  1. এই শর্তাবলীতে সম্মতি দেয়ার মাধ্যমে আপনি নিশ্চিত করছেন যে আপনি বুঝতে পারেন NLN আপনাকে চিকিৎসাগত, স্বাস্থ্য কেন্দ্রিক অথবা সহায়তামূলক কোন উপদেশ দিবে না এবং চিকিৎসাগত জরুরী অবস্থার ক্ষেত্রে এর ব্যবহার করা উচিত নয়। যতক্ষণ পর্যন্ত আইনের অনুমতি আছে, ততক্ষণ পর্যন্ত, আপনি এ সকল বিষয় না বোঝার ফলে যে ধরণের ক্ষতি অথবা আহত হওয়ার মতো ঘটনার সম্মুখীন হবেন তার কোনোটির জন্য B&SF এবং NLN দায়ী থাকবে না।

 

  1. আপনি অথবা অন্য কেউ, ঝুঁকিতে থাকতে পারেন এমন নির্দেশক কোন আলোচনা, ইমেইল, পোস্ট, মেসেজ, রিপ্লাই, প্রশ্ন অথবা কমেন্ট, সংশ্লিষ্ট পরিষেবা (এর মধ্যে প্রয়োজনীয় ক্ষেত্রে নাম এবং যোগাযোগের তথ্য এবং আপনাকে নোটিশ দিয়ে কিংবা না দিয়ে, রেফারেন্স হিসেবে ব্যবহার করে কিংবা না করে)-এর সাথে শেয়ার করার জন্য আমাদের নিরাপত্তা প্রদানের একটি দায়িত্ব থাকতে পারে। নির্যাতন অথবা অবহেলা নির্দেশক অথবা রেফারেন্স হিসেবে কাজ করতে পারে এমন সব কিছু এর মধ্যে অন্তর্ভুক্ত। তবে, এমন দুশ্চিন্তা অথবা প্রকাশের বিষয়ে আমরা নির্দিষ্ট করে NLN-এ নজরদারি করি না এবং এমন দুশ্চিন্তা উত্থাপন করার জন্য NLN একটি উপযুক্ত ফোরাম নয়, এগুলো সংশ্লিষ্ট স্থানীয় কর্তৃপক্ষের কাছে অথবা জরুরী পরিষেবার কাছে সরাসরি এবং উপযুক্ত পদ্ধতিতে রেফার করা উচিত।

  • NLN-এ, পার্শ্ব-প্রতিক্রিয়া এবং ঔষধ অথবা চিকিৎসার ধরণের মধ্যে একজন ব্যক্তি যে অ্যাট্রিবিউশন করেন তাতে সে ব্যক্তির মতামত প্রকাশ পায়, B&SF-এর মতামত নয়।

B&SF এবং NLN, প্রযোজ্য আইনের অনুমোদন অনুযায়ী সর্বোচ্চ পরিসরে, NLN উদ্ভূত অথবা এর সংস্পর্শে আসার পরে ছড়ানো কম্পিউটার ভাইরাস অথবা অন্যান্য ক্ষতিকারক কোড-এর ফলে যে ক্ষতি হবে তার দায়ভার থেকে মুক্ত। B&SF আপনাকে পরামর্শ দিবে যে B&SF/NLN থেকে পাওয়া ইমেইল থেকে সকল ম্যাটারিয়াল ডাউনলোড করার আগে আপনার ভাইরাস আছে কিনা তা পরীক্ষা করে দেখা উচিত এবং আপনার উচিত নিয়মিত আপনার ডিভাইসে ভাইরাস কিংবা অন্য ক্ষতিকারক কোডের উপস্থিতি যাচাই করে দেখা।

 

  1. আইনের অনুমোদন সাপেক্ষে, B&SF এবং NLN অন্যান্য সকল শর্তাবলী, ওয়ারেন্টি, উপস্থাপনা অথবা NLN বা এর কোনো কনটেন্টের ক্ষেত্রে প্রযোজ্য প্রকাশিত বা অপ্রকাশিত অন্য কোনো শর্ত বর্জন করে। চুক্তি, টর্ট (অবহেলা সহ), সংবিধিবদ্ধ কর্তব্য লঙ্ঘন বা অন্য কোনো ভাবে হওয়া ইউজারের কোনো ক্ষয় বা ক্ষতির জন্য B&SF এবং NLN দায়ী থাকবে না, এমনকি সেটা যদি পূর্বাভাসযোগ্য এবং নিচের বিষয়গুলোর ফলে বা বিষয়গুলোর সাথে সম্পৃক্ত থাকার ফলে হয় তবুও:
  2. NLN-এর ব্যবহার অথবা এটি ব্যবহারে অক্ষমতা।
  3. আমাদের গোপনীয়তা নীতি, অন্যান্য দাবিত্যাগ ও বিভিন্ন নোটিশ পড়তে ব্যর্থ হওয়া যেগুলোতে আপনি রেজিস্ট্রেশন করার সময় সম্মতি দিয়েছেন; অথবা
  4. NLN-প্রদর্শিত কনটেন্টের ব্যবহার অথবা বিশ্বস্ততা।

 

অন্যান্য গুরুত্বপূর্ণ টার্ম

  1. এই শর্তাবলীর প্রত্যেকটি অনুচ্ছেদ পৃথকভাবে কাজ করে। যদি আদালত অথবা সংশ্লিষ্ট কর্তৃপক্ষ এই সিদ্ধান্ত নেয় যে কোন অনুচ্ছেদ বেআইনি অথবা বাস্তবায়ন যোগ্য নয় তবে বাকি অনুচ্ছেদ সম্পূর্ণ পরিসরে কার্যকর থাকবে।

 

  1. B&SF যদি আপনার কর্তব্য পালন করতে আপনাকে জোর না করে অথবা B&SF যদি আপনার উপর তাদের অধিকার প্রয়োগ না করে বা প্রয়োগ করতে দেরি করে, এর মানে এই নয় যে B&SF আপনার উপর তাদের অধিকার মৌকুফ করেছে এবং আপনাকে আর আপনার কর্তব্য মেনে চলতে হবে না।

 

  1. এই টার্মগুলো শুধু ইংরেজ আইনের তত্বাবধানের অধীনস্থ এবং শুধু ইংরেজিতে এভেইলেবল। B&SF এবং আপনি উভয়েই এই বিষয়ে সম্মত যে, এই শর্তাবলীর অধীনে উদ্ভূত যেকোনো বিবাদ বা দাবীর উপর England এবং Wales কোর্টের স্বতন্ত্র এখতিয়ার রয়েছে।

 

অভিযোগ এবং উপদেশ

  • আপনার যদি নিম্নের কোনটি থাকে:
  • B&SF অথবা NLN বরাবর আপনি উত্থাপন করতে চান এমন দুশ্চিন্তা অথবা ফীডব্যাক;
  • প্রণীত পরিষেবা সম্পর্কে অভিযোগ অথবা মন্তব্য; অথবা

NLN এবং এই শর্তাবলীতে আসা পরিবর্তন

  1. B&SF-এর এই অধিকার আছে যে তারা নির্দিষ্ট সময়ের ব্যবধানে NLN-এর রক্ষণাবেক্ষণ এবং আপডেট করতে পারবেন। এই ধরণের পরিবর্তন নিয়ে আসার সময়, NLN ব্যবহারকারী সকল ব্যক্তি এবং আমন্ত্রণ প্রাপ্ত ব্যক্তিদের সমস্যার পরিমাণ একেবারে কমিয়ে নিয়ে আসার জন্য সর্বোচ্চ চেষ্টা করা হবে।

 

  1. NLN-এর যেকোনো অংশ অথবা তৃতীয় পক্ষের কনটেন্ট এবং এর পাশাপাশি এই শর্তাবলী পরিবর্তন করার অথবা সম্পূর্ণরূপে NLN বাতিল করার অধিকার B&SF রাখে এবং এই অধিকার অনুশীলন করার মধ্যে দিয়ে যে ধরণের দায়বদ্ধতা দেখা দিতে পারে সেগুলো B&SF মেনে নিবে না। সম্ভাব্য ক্ষেত্রে NLN-এর মাধ্যমে এমন ধরণের যৌক্তিক নোটিশগুলো আপনাকে B&SF প্রদান করবে। এই শর্তাবলীর সর্বাপেক্ষা সাম্প্রতিক কপির জন্য অনুগ্রহ করে এখানে নিয়মিত দেখুন।
